Terms of Service

These terms are an agreement between you and FantaSim Football LLC ("FantaSim Football," "we," "us"), a Pennsylvania limited liability company, covering your use of the website and game at fantasimfootball.com (the "Service").

By creating an account or using the Service, you agree to these terms. If you do not agree, do not use the Service.

1. What the Service is

FantaSim Football is a fantasy football simulation game. You draft a roster of real NFL players from a completed historical season and a simulation engine replays that season using those players' actual game-by-game statistics.

The Service is a game of skill played for entertainment. There is no wagering, no entry fee, and no cash or material prize of any kind. Players compete for standings and bragging rights.

The Service is not affiliated with, endorsed by, or sponsored by the National Football League, any NFL team, or any player.

2. Early access

The Service is in closed early access. That means:

• Accounts are created by invitation and approved manually. We may approve or decline any account at our discretion.
• Features will change, and some will be removed.
• The Service may be unavailable, and leagues in progress may be interrupted, reset, or deleted while we develop it.
• We do not promise that any league, roster, or result will be preserved.

3. Eligibility

You must be at least 18 years old to use the Service. You are asked to confirm this when you create an account, and by doing so you represent that it is true.

If we learn that an account belongs to someone under 18, we will close it and delete the information associated with it, other than records we are required to keep for legal, security, or fraud-prevention reasons.

4. Your account

You are responsible for your account and for anything done through it. Keep your password confidential. Tell us promptly at info@fantasimfootball.com if you believe someone else has used your account.

One person, one account. Do not create accounts on behalf of anyone else.

5. Acceptable use

Do not:

• use the Service for any unlawful purpose;
• use another person's account, or let anyone use yours;
• create multiple accounts to gain an advantage in a league;
• attempt to access parts of the Service you are not authorised to access, or interfere with its operation;
• scrape, copy, or redistribute the Service's data in bulk;
• choose a display name or team name that is unlawful, harassing, hateful, or obscene;
• use the Service to harass or abuse other players.

We may suspend or terminate your account for any of the above.

6. Content you provide

You choose your display name and team names. You are responsible for them. You grant us permission to display them to other players in your leagues and within the Service.

We may remove or change any name that violates these terms.

7. Statistical data and attribution

Historical NFL statistics used by the Service are derived from nflverse data, made available under the Creative Commons Attribution 4.0 International licence. Attribution is provided at fantasimfootball.com/attribution.

The simulation engine, the game design, the interface, and all other materials of the Service are owned by FantaSim Football LLC.

8. Fees

The Service is currently free. We intend to offer optional paid subscription tiers in future. If we do, we will publish the price and terms before charging anyone, and no charge will be made without your express agreement.

9. Availability

We do not promise that the Service will be available at any particular time or without interruption. We may change, suspend, or discontinue any part of it, including any league in progress, at any time.

10. Termination

You may stop using the Service at any time and may ask us to delete your account by emailing info@fantasimfootball.com.

We may suspend or terminate your access at any time, with or without notice, if you breach these terms or if we discontinue the Service.

11. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, OR THAT ANY DATA WILL BE PRESERVED.

12. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, FANTASIM FOOTBALL LLC WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, USE, OR GOODWILL, ARISING OUT OF YOUR USE OF THE SERVICE.

OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF THE AMOUNT YOU PAID US IN THE TWELVE MONTHS BEFORE THE CLAIM, OR ONE HUNDRED U.S. DOLLARS.

Some jurisdictions do not allow these limitations, in which case they apply to the fullest extent permitted.

13. Indemnity

You agree to indemnify and hold harmless FantaSim Football LLC from any claim arising out of your use of the Service or your breach of these terms.

14. Governing law

These terms are governed by the laws of the Commonwealth of Pennsylvania, without regard to its conflict of laws rules. Any dispute will be brought in the state or federal courts located in Pennsylvania, and you consent to their jurisdiction.

15. Changes to these terms

We may update these terms. When we make a material change we will update the "Last updated" date above and, where appropriate, notify you by email. Continuing to use the Service after a change means you accept the updated terms.
